Terms of Service

Introduction
Welcome to Chatter! These Terms of Service ("Terms") govern your use of the services provided by Chatter Software Development, Inc. ("Chatter," "we," "us," or "our"), including our machine connectivity platform, hardware, and related services (collectively, the "Services"). By using our Services, you agree to these Terms. If you do not agree to these Terms, please do not use our Services.

Services Overview
Chatter offers multiple subscription plans: Chatter Connect, Chatter Core, and Chatter Enterprise. Each plan includes different tiers and pricing options. Subscriptions are available on a monthly or annual basis, with recurring billing facilitated by our payment processor, Stripe.

Trial Period
We offer a 30-day trial period for our Services, which does not include hardware. A valid credit card must be on file to start the trial. The card on file will be billed at the end of the trial period unless the subscription is canceled before the trial ends.

Hardware
For Chatter Core and Chatter Enterprise tiers, we provide hardware ("Chatterbox") as part of the subscription. The Chatterbox hardware remains the property of Chatter Software Development, Inc. and must be returned if the subscription is canceled.

Billing and Payment

  • Subscriptions are billed on a recurring basis, either monthly or annually, based on the plan selected.
  • All billing is handled through Stripe. By providing your payment information, you authorize us to charge your payment method on a recurring basis as specified in your subscription plan.
  • You may update your payment information at any time through your account settings.

Refund Policy
Refunds are available under the following conditions:

  • If you cancel your subscription within the first 30 days of a paid period, you may request a prorated refund for the unused portion of the subscription.

Delivery Policy
Our Services, including hardware for applicable plans, are shipped to the address provided during registration. Delivery timelines are as follows:

  • Hardware is shipped within 1-3 business days after the subscription start date.
  • Delivery is available to locations within the United States. For international shipping, please contact our support team for availability and additional shipping fees.

Return Policy
Hardware provided as part of the Chatter Core and Chatter Enterprise plans must be returned under the following conditions:

  • If the subscription is canceled, the Chatterbox hardware must be returned within 30 days of cancellation.
  • Return shipping costs are the responsibility of the customer. Hardware must be returned in good working condition, subject to reasonable wear and tear.

Cancellation Policy
You may cancel your subscription at any time through your account settings. The cancellation will take effect at the end of the current billing period. Upon cancellation, any hardware provided must be returned within 30 days.

User Responsibilities

  • You are responsible for maintaining the confidentiality of your account information, including your password.
  • You agree to use the Services in compliance with all applicable laws and regulations.
  • You are responsible for all activities that occur under your account.

Data Privacy
Chatter is committed to protecting your privacy and data security. Our Privacy Policy outlines how we collect, use, and protect your information. By using our Services, you agree to our Privacy Policy.

Limitation of Liability
To the maximum extent permitted by law, Chatter Software Development, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the Services;
  • Any unauthorized access to or use of our servers and/or any personal information stored therein;
  • Any interruption or cessation of transmission to or from our Services.

Changes to the Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website. Your continued use of the Services after such changes have been posted constitutes your acceptance of the new Terms.
